Disability-related assistive-support recognition
Proposed federal reform · Stakeholder consultation draft
This page describes a proposed federal legislative change. The provisions described here are proposed changes, not enacted law. Existing requirements vary by setting and statute. Any change would require appropriate legislative and regulatory action.
What this component proposes
Clarify recognition of trained service-dog assistance as disability-related support across covered settings.
- Recognize trained mobility, medical-alert and psychiatric tasks without favoring one disability category.
- Avoid substituting aides or other supports for a qualified team without individualized analysis.
- Maintain the distinction between trained tasks and comfort alone under applicable definitions.
Current federal law and proposed change
This component describes a proposed reform, not an enacted federal requirement. Existing protections depend on the setting and may arise under the ADA, Rehabilitation Act, Fair Housing Act, Air Carrier Access Act, veterans' benefits laws or state law. The general DOJ references below explain ADA public-access rules only; they do not establish every setting-specific rule or endorse this proposal. A component-specific, source-cited legal comparison is still required.
Primary federal references
- U.S. DOJ: ADA Service Animals FAQ (general public-access baseline)
- U.S. DOJ: ADA Service Animals Requirements
These sources explain general ADA public-access guidance, not every setting-specific rule. They do not endorse this legislative proposal. A full cross-statute legal analysis is still in development.
Implementation and legal questions
- Different federal statutes define assistance animals differently.
- Drafting must not narrow protections for people with nonvisible disabilities.
Questions for working teams and stakeholders
- Where are legitimate tasks misunderstood?
- What wording would improve recognition without exposing medical details?
Feedback is welcome from owner-trained and professionally trained teams, including people who oppose mandatory registration. Please reference Component 13 in your response.
